Family members of EU, Swiss or EEA nationals excericising treaty rights in another EU or EAA country

Family members of an EU/EEA citizen or Swiss citizen who is exercising his/her right to free movement in Europe, have the right to have a visa application processed in accordance with EU regulations, Directive 2004/38/EC if the family member is accompanying or joining the EU/EEA citizen or Swiss citizen.

Family members are defined as:

  • The direct descendants (children) who are under the age of 21 or are dependants, and those children/dependents of the spouse or partner. 
  • The dependant direct relatives in the ascending line (e.g. parents) and those of the spouse or partner.

The visa application must still be lodged at the closest VFS centre in Pretoria, Johannesburg, Cape Town or Durban, however, there is no processing fee (only the admin fee to VFS), and this type of visa application is processed according to a faster procedure which may only in exceptional cases take longer than 15 days.

Unlike other visa applicants, these applicants are not required to submit a travel medical insurance and proof of accommodation. Nor are they required to submit bank statements reflecting sufficient funds enabling them to support themselves during their stay in Denmark.

Please note that these applications are conditional upon the free movement of the EU spouse/partner, plus the fact that the applicant and the EU spouse/partner will be visiting the Schengen country together.
